McGettigan Group Regains Control Of Regency Hotel
AMOSS recently acted for the company that owns and operates the Regency Hotel in undergoing a restructuring through examinership. The company, and a related company, applied for Court protection following the appointment of a Receiver and Manager by an Oaktree vehicle that had acquired the debt and security from NAMA.
The examinership utilised the maximum period of 100 days for the Examiner to submit his Proposals for a Scheme of Arrangement to the Court, which were confirmed on day 107 of the process. The Examiner’s Proposals provided for payment in full of all of the company’s debts (in excess of €20m), which is the exception rather than the rule in examinership cases. As a result of the Proposals ownership of the companies remained with the family that owned them prior to entering examinership.
